Alleged Orlando Cop Killer Charged. Aired 8-9p ET

Aired January 19, 2017 - 20:00   ET

THIS IS A RUSH TRANSCRIPT. THIS COPY MAY NOT BE IN ITS FINAL FORM AND MAY BE UPDATED.

(BEGIN VIDEOTAPE)

MARKEITH LOYD, ACCUSED OF MURDER: (EXPLETIVE DELETED) you.

ASHLEIGH BANFIELD, HOST (voice-over): Belligerent, abusive and bandaged, an accused cop killer lets loose on a judge.

LOYD: (INAUDIBLE) (INAUDIBLE)

BANFIELD: He refuses a lawyer.

UNIDENTIFIED FEMALE: Do you know the maximum penalties associated with these offenses?

MARKEITH LOYD, ACCUSED OF MURDER: Really don`t matter.

BANFIELD: And says it`s not his fault his pregnant girlfriend was shot dead.

LOYD: You all are acting like I just went there and shot her.

BANFIELD: All this as police release the night vision view of what it took to take him down.

UNIDENTIFIED MALE: And just be prepared. Set a wide perimeter.

UNIDENTIFIED MALE: Coming across the front yard now.

BANFIELD: A secret video that will give you the willies.

UNIDENTIFIED MALE: Just take a deep breath.

BANFIELD: That`s a divorce attorney. So why is he putting his client in a trance?

UNIDENTIFIED MALE: (INAUDIBLE)

BANFIELD: Immoral, illegal, the bust caught on camera, a young mother`s sick solution for her active toddler.

UNIDENTIFIED FEMALE: Tape him to the wall.

(END VIDEO CLIP)

BANFIELD: Duct-taped to a wall, a frantic toddler wails as his teen mom just cleans the house.

UNIDENTIFIED FEMALE: Don`t make me put more tape up there.

BANFIELD: All the while, she live streams on Facebook.

UNIDENTIFIED FEMALE: You got your best mommy in the whole wide world.

BANFIELD: And heartless thieves break into a widow`s home on the worst possible day.

UNIDENTIFIED FEMALE: Woke up to go to my husband`s funeral.

(END VIDEOTAPE)

BANFIELD: Hello, everyone. I`m Ashleigh Banfield. Welcome to PRIMETIME JUSTICE.

It is not every day you see a man square off against a judge dressed in Kevlar, bandaged to the hilt and letting loose with an F bomb in court.

But it is not every day a man like this, Markeith Loyd, is paraded into court. He`s the bad guy police hauled in after a month-long manhunt and a

trail of bodies in his wake, including a cop and a pregnant ex-girlfriend.

So you would think with the weight of three homicides bearing down on him, surrounded in fellow cops, friends of that dead officer, that he might keep

his head low. Not this guy. Instead, no remorse. He was outright abusive, and he ignored his right to remain silent. It seemed he just

couldn`t help himself from letting loose and even justifying the killing of the mother of his unborn child.

(BEGIN VIDEO CLIP)

LOYD: I want to do something back. You all portray this (EXPLETIVE DELETED) to the news people like I just went there and shot this girl when

there was other guns found on the scene. (INAUDIBLE) a gun was pulled on me (INAUDIBLE) Y`all are acting like I just went there and shot her. Her

little brother got dropped off while me and her was standing there talking. So there was all kind of other (EXPLETIVE DELETED) happened before

(INAUDIBLE) Oh, I just went there shot this girl, got my family (INAUDIBLE) So no, I wasn`t (INAUDIBLE)

UNIDENTIFIED FEMALE: (INAUDIBLE)

LOYD: (EXPLETIVE DELETED) you.

UNIDENTIFIED FEMALE: Have him sign the no contact.

LOYD: (EXPLETIVE DELETED) (INAUDIBLE) (EXPLETIVE DELETED) you. (INAUDIBLE) about that (EXPLETIVE DELETED)

(END VIDEO CLIP)

BANFIELD: During all of this, Markeith Loyd refused a court-appointed lawyer, said he could do the job himself. And to the cops who hold him in,

in that violent takedown that resulted in an overnight hospital stay, he said he wasn`t resisting arrest at all.

For their part, the police chief in Orlando says his officers used, quote, "great restraint," but that nevertheless, they will investigate the use of

force in the arrest of Markeith Loyd.

And you are looking at it. It`s just released night vision shots of the tactical operation that they mounted against him on Tuesday night. It is

very telling, some of these pictures.

And then later today, Markeith learned something brand-new. He was being charged with first degree murder in the death of that beloved Orlando cop,

Lieutenant Debra Clayton. The chief says he gunned her down execution- style at a Wal-Mart while on the run for weeks for that murder of his ex- girlfriend.

Darrin Porcher is a retired NYPD lieutenant and criminal justice expert. He joins me live now. So I have to...

DARRIN PORCHER, CRIMINAL JUSTICE EXPERT: Thanks for having me.

BANFIELD: It`s good to have you here. It is so remarkable, the fast- moving details in this story. What I`d like to do, if I can, is I want to show of that some night vision, if I can, so that we can see exactly what

it was...

PORCHER: Sure.

BANFIELD: ... they had to do to make sure that they got this guy and that none others, no other officers would end up in the same boat as Debra

Clayton. Have a look at this.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: This is about (INAUDIBLE) let us know when it`s time.

UNIDENTIFIED MALE: When you get (INAUDIBLE) you`re listening and just be prepared to set a wide perimeter. Charlie 36, go ahead and set a perimeter

on the whole neighborhood.

UNIDENTIFIED MALE: (INAUDIBLE)

UNIDENTIFIED MALE: No one on that street.

UNIDENTIFIED MALE: You said no one on the street?

UNIDENTIFIED MALE: (INAUDIBLE) crawling out the front door, guys. Crawling across the front yard now (INAUDIBLE)

UNIDENTIFIED MALE: (INAUDIBLE)

UNIDENTIFIED MALE: All units going back to Charlie 36, if you`re not on a priority call, you need to be (INAUDIBLE)

UNIDENTIFIED MALE: (INAUDIBLE) this guy does. (INAUDIBLE) right across the sidewalk towards the units.

(END VIDEO CLIP)

[20:05:08]BANFIELD: Darrin Porcher, this is just incredible video that we`re watching. It played out in real time for them. We`re watching the

benefit (ph) of the tape. What do you see when you watch this takedown, this guy crawling out across the lawn and then just being virtually

surrounded by dozens of officers?

PORCHER: Well, it was clear that Mr. Loyd had a demonstrated propensity for violence. That`s why the officers needed to confront him in this

matter. Traditionally, when do you an injury on an individual like this, you`re going to have hostage negotiation,a quote, unquote, "squat (ph)

team," and an ambulance that`s going to come in toe (ph) to address -- to confront this type of individual.

This was the safest way to get him out of this residence. Keep in mind, this was an abandoned house. And so when they -- whoever -- whatever

officer engaged him with the commands, they specifically asked him, Lay down. Keep both your hands out and crawl until you get to the sidewalk.

This is the safest method possible in getting him -- getting the extraction because we got to keep -- take in consideration this is someone that not

only killed his loved one, but he also killed a law enforcement officer.

So as we move forward, we also have a complaint of a level of excessive force. It`s very difficult to make that assessment based on this video,

but it`s safe to say that this is someone that fortunately came out of this encounter with his life.

BANFIELD: And it`s just incredible to see the swarm, the virtual swarm of SWAT officers, tactical team members, cops who all come in on this very

important collar. You can tell they knew exactly what kind of guy they were coming after and they were prepared for it, just the volume of

manpower, vehicles that swarmed in, the helicopter, the night vision, everything captured on tape.

I want to bring in Ray Caputo. He`s a reporter for news 96.5 WDBO, joins me live from Orlando. Ray, this whole business about use of force -- look,

it is no secret. We watched that guy getting marched into the PD with what looked like two black eyes, and we saw him being marched out of the PD and

he had triage work from the firemen who were at the police department, and he was on his way to the hospital.

I want to remind you what it looked like and what he said on his way out.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Markeith, don`t you wish you would have just gone to jail a week ago? You have anything you want to say for yourself?

LOYD: They beat me up.

(CROSSTALK)

UNIDENTIFIED FEMALE: Do you think you should have turned yourself in a week ago?

(END VIDEO CLIP)

BANFIELD: The only thing he said, nothing else about anybody else who was injured or died in this entire odyssey. So Ray, real quickly, he said in

court something about a fractured left orbital bone and damage to one eye. I think he ever alluded to losing an eye. What do we know about his actual

injuries?

RAY CAPUTO, WDBO: Yes, well, you said it. He has a fractured orbital bone. He has some damage to his eye. We don`t know if he`s going to lose

sight or not. But he looked pretty battered in court today. I mean, we saw him last night, but this morning, he didn`t look, you know, much

better.

Now, in terms of those injuries, in terms of the use of force, you got to keep in mind that when police encountered him, even though he was crawling

on the ground, I mean, Ashleigh, they took into context all the things that this guy was accused of doing and they handled him accordingly. So you

know, the use of force stuff is going to come out, because in terms of his injuries right now, I mean, he has seen better days, let`s just put it that

way.

BANFIELD: Yes, without question. But Darrin Porcher, I want you back in on this. At the same time I`m going to show you what the cops saw he flung

on the ground as he came out that front door and ultimately got down on his belly. There were two guns, and one of those guns looked like a -- for

lack of a better term, a Tommy handgun. Do you see that one on the bottom? That thing holds a hundred rounds. And these are the two weapons that this

guy had on him as he came out the front door. They also knew he had body armor.

So when you say use of force, Darrin Porcher, and you`re dealing with a guy who had body armor, who was accused of these horrifying killings and then

is armed with those kind of weapons, what kind of use of force is OK when you go into a situation like that?

PORCHER: Well, I was a lieutenant in the internal affairs bureau in the NYPD, and oftentimes, I`ve investigated these types of use of force

allegations. This is an individual that was ready for war. He clearly demonstrated a ferocity (ph) for valiance (ph) in connection with shooting

the police officer. And we had these firearms that were present at the scene.

Therefore, I understand officers approaching this individual -- and it`s too early to tell if they used a minimum amount of force. However, at the

same token, Mr. Loyd left this encounter with his life. Granted, he did incur...

BANFIELD: (INAUDIBLE)

PORCHER: Right, right. He incurred some injuries, but ultimately, look at what we have here. We have a series of guns. These guns are designed to

kill people, not hunt.

BANFIELD: And by all accounts, those are the accusations, that he did that several times. One of their friends was one of the victims, as well.

[20:10:04]I want to bring in former prosecutor Jason Oshins, defense attorney Heather Hansen, and defense attorney, CNN and HLN legal analyst

Joey Jackson.

You heard Darrin Porcher say this man was ready for war. It was clear from the beginning with the kind of body armor he had before they even got to

that scene. It was clear when he crawled out of that front door and he had those guns. So I think my question -- Joey, I`ll give this one to you.

Who cares at this point about Markeith Loyd?

(LAUGHTER)

BANFIELD: And I am sorry to say it in those terms, but I mean it! What lawyer is going to rush to his aid to mount a defense against all that

excessive force for a guy like that who was, quote, "ready for war"?

JOEY JACKSON, CNN/HLN LEGAL ANALYST: I don`t think the -- the answer is no one does, but I don`t think there will be a lawyer coming to his defense.

Why? Because he wants to self-represent. He wants to represent himself, as he tells the judge F you, et cetera, et cetera, engages in disrespect,

et cetera, and he has a right to do that, Ashleigh.

And so, look, if he`s competent -- and he appears to be competent enough to disrespect the judge and to say, They beat me, et cetera -- he`ll have a

right to represent himself. What a zoo that`ll be.

The other question for me is what the application of the death penalty would be here. Why? Because it was suspended in Florida in October. So

the issue is whether it could even apply in his case and whether there would be a punishment that would even suit what he did.

BANFIELD: Joey Jackson says it, so we get the video instantaneously. In fact, Markeith Loyd`s curse-filled morning in court certainly did give us

some clues about how he might, actually, Joey, want to face those murder charges and who he might want to help him. Have a listen. Here it is.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: OK. And do you plan to hire your own attorney.

LOYD: I`m going to defend myself.

UNIDENTIFIED FEMALE: You`re going to defend yourself pro se? And what`s the highest grade that you completed in school, Mr. Loyd? Have you ever

represented yourself in a criminal case before? Do you know the maximum penalties associated with these offenses?

LOYD: It don`t matter.

(END VIDEO CLIP)

(COMMERCIAL BREAK)

[20:15:55]BANFIELD: Accused cop killer and ex-girlfriend killer Markeith Loyd said in his outlandish court appearance today that he wants to

represent himself. He actually rejected the judge`s offer of a court- appointed attorney. And in the process, he just went off, rambling and cursing in just about everyone`s direction, including the judge.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Good morning, sir. Can you please tell me your name?

LOYD: My name is Markeith Loyd.

UNIDENTIFIED FEMALE: Officers, can you pull the mic a little bit closer? Good morning, Mr. Loyd. You`re here for first appearances pursuant to

arrest warrant for events occurring on December 13th of 2006 (ph). Count 1, first degree murder with firearm. Count 2, killing an unborn child by

injury to a mother. Count 3, attempted first degree murder with a firearm. Count 4, aggravated assault with a firearm. And finally, count 5,

aggravated assault with a firearm. Again, PC was found because this was pursuant to a warrant.

Sir, you are entitled to the services of a public defender. It`s my understanding that you did not want to fill out an application. Do you

want a public defender appointed to represent you, Mr. Loyd?

LOYD: No.

UNIDENTIFIED FEMALE: OK. And do you plan to hire your own attorney?

LOYD: I`m going to defend myself.

UNIDENTIFIED FEMALE: You`re going to defend yourself pro se? And what`s the highest grade that you completed in school, Mr. Loyd? Have you ever

represented yourself in a criminal case before? Do you know the maximum penalties associated with these offenses?

LOYD: It don`t matter.

UNIDENTIFIED MALE: OK. Can you read, write and understand the English language? And you believe you can defend yourself?

LOYD: I do.

UNIDENTIFIED FEMALE: And you understand that you have -- you understand the nature of these offenses, sir?

LOYD: Say it again?

UNIDENTIFIED FEMALE: And You understand the nature and severity of these offenses, sir? Are you sure you don`t want a public defender appointed to

represent you?

LOYD: (INAUDIBLE)

UNIDENTIFIED FEMALE: I`m sorry, sir, what did you say?

LOYD: I said nothing.

UNIDENTIFIED FEMALE: OK, so here`s what I`m going to go ahead and do.

LOYD: Well, first of all, I got a question to ask.

UNIDENTIFIED FEMALE: You`re here for first appearances on a warrant, sir.

LOYD: Y`all making up (EXPLETIVE DELETED), like I just went in there and shot this girl, endangered my family.

UNIDENTIFIED FEMALE: OK, and...

LOYD: (INAUDIBLE) you want to do something back to the officer. Y`all portrayed this (EXPLETIVE DELETED) to the news people like I just went in

there and shot this girl, when there was other guns found on the scene. (INAUDIBLE) a gun was pulled on me (INAUDIBLE) acting like I just went

there and shot her. Her little brother got dropped off while me and here standing there talking. So there was all kind of other (EXPLETIVE DELETED)

happening before (INAUDIBLE) Oh, I just went there and shot this girl, got my family in danger. So no, I wouldn`t (INAUDIBLE)

UNIDENTIFIED FEMALE: State`s requesting Mr. Loyd be placed under oath before any further procedures.

UNIDENTIFIED FEMALE: He`s already been placed under oath.

LOYD: (INAUDIBLE) under oath.

UNIDENTIFIED FEMALE: Everything you say is being recorded, sir, so...

LOYD: She should know that. She a lawyer. What`s she talking (INAUDIBLE)

UNIDENTIFIED FEMALE: So here`s what I`m going to go ahead and do. I`m going to go ahead...

UNIDENTIFIED MALE: (INAUDIBLE)

LOYD: I`m not finished talking because y`all been making up (EXPLETIVE DELETED) the whole time. And then you all make up stuff on my family, lock

them up because my -- I work. I work two, three jobs. I work and I work for that money. And that`s why he gave that money to my daughter and he

gave my niece the other half because he didn`t give my daughter all of it. That money was not for me.

UNIDENTIFIED MALE: All right. Here`s what I`m going to go ahead and...

LOYD: I haven`t seen nothing from nobody. I was out there by myself. (INAUDIBLE) anybody help me do anything. (INAUDIBLE) about myself to buy

food (ph). Wasn`t nobody doing nothing for me.

UNIDENTIFIED MALE: Sir, we`re only addressing the one case. And I told you what you`re here for.

LOYD: (INAUDIBLE) I don`t care (INAUDIBLE)

UNIDENTIFIED MALE: I`m going to set -- on counts 1, 2 and 3, bond is going to be set at no bond. Additionally, on counts 4 and 5, I`ll set bond

$1,500 apiece, totaling no bond plus $3,000.

Additionally, I`m ordering some special conditions. You are not to contact Ronald Stuart (ph), the victim in one of these counts. Additionally, you

are not to contact any witnesses or victims, family members, Mrs. Dixon`s family members. I want to be clear on this. You are not to have any

contact, whether it`s third party contacts through other people, no telephone communication.

[20:20:00]I`ll have him read that in just a moment. You`re not to contact Dominic Daniels (ph), Stephanie Dixon Daniels (ph), Ron Daniels (ph) or her

children.

There is a form there that you`re going need to sign off on. I`m going to go ahead and we`ll give you a court date sometime out. It`ll be on the

paperwork for determination of counsel.

LOYD: When they had me in the hospital, channel 9 (INAUDIBLE) waiting for me to come out and see what they did. But they done took my eye. They

done (INAUDIBLE) broke my jaw. They did all this (EXPLETIVE DELETED) because I resisted, but I crawled out to (EXPLETIVE DELETED) how did I

resist? I didn`t resist (EXPLETIVE DELETED). They just did this and they tried to hide it from the news people. But I`m here right now.

UNIDENTIFIED MALE: Corrections, I think we`ve established everything we need to do on a first appearance here. And he can be taken after he

signs...

LOYD: (EXPLETIVE DELETED) you.

UNIDENTIFIED FEMALE: Have him sign the no contact.

LOYD: (EXPLETIVE DELETED) you. (INAUDIBLE)

(END VIDEO CLIP)

BANFIELD: Not usually the kind of thing you should do ever, let alone in a court when you`re facing down murder charges. And there was something new

that man learned that tonight because his jail records just were updated, and I have them, just (INAUDIBLE) an hour-and-a-half or so ago, brand-new

charges. And they`re not small -- the first degree murder, attempted first degree murder with a firearm of a law enforcement officer. So this is

pertaining to Lieutenant Debra Clayton.

And if Mr. Markeith Loyd thinks that he can beat the rap on what he just made his court appearance for, that pregnant ex-girlfriend who was shot,

her brother who was shot and injured, I`m not so sure he`s going to have such an easy go with the killing, the murder, the cold-blooded execution-

style murder of Lieutenant Debra Clayton because the police chief himself was on this show last night exclusively telling us there is video that the

chief himself has watched of what Markeith Loyd did to that officer outside the Wal-Mart -- execution-style.

Have a listen to what he said.

(BEGIN VIDEO CLIP)

JOHN MINA, ORLANDO POLICE CHIEF: All`s I will tell you, there was multiple shots and that, like I said, he could have easily gotten away after she lay

on the ground bleeding, but -- from a non-fatal wound, but he decided to go up and kill her execution-style, like you said, when she was totally

defenseless. And the fatal wound was when he approached her and shot her while he was standing over her.

(END VIDEO CLIP)

BANFIELD: Jason Oshins, you said that this is all about street credit for him. This isn`t even about defending himself. This isn`t even about

mounting a defense at all. This is about him in prison because he knows he`s going to be there for a long time.

JASON OSHINS, FORMER PROSECUTOR: Well, that`s his focus. I mean, he`s not worried about defending himself in any way. He`s worried about the

perception that he killed this pregnant woman and he didn`t have justification and that she was pregnant. That`s what he cares about. That

was his whole soliloquy is not in any way defending himself or looking for counsel, but you know, They pulled a gun on me. It was about money. I had

justification. That`s the reason I killed her.

BANFIELD: All right, Ray Caputo, I want you to come in for a second on this because there was some reporting that his family, Markeith Loyd`s

family members, almost a half dozen, I think, were there actually supporting him in court today.

CAPUTO: Yes. It was really...

BANFIELD: You know what? We just lost Ray. I`m so sorry. If we could get him back up again, I want him to answer that question.

So in the meantime, I`m going to show you these four people. Pop that back up, guys. Pop that graphic back up because this is also sort of friends

and family because right now -- God, with friends like these -- this whole group of people are in the same facility as Markeith Loyd. Zarghee Maya

(ph), his former boss. Lakensha Smith-Loyd is his niece. Jamia (ph) is his ex-girlfriend. And look at that on the far end, Another Markeith

Loyd. That would be his son, Markeith Loyd, Jr. They are all in the same facility as Markeith Loyd.

And there is an order of no contact. So Markeith, you may be locked and looking for your street credit, but don`t be looking to talk to these

friends and family. You`re not allowed.

Darrin Porcher, to that end, him in lock-up -- I can`t imagine the secure surroundings for a guy like this. He`s not like any other inmate.

PORCHER: Well, he`s more than likely going to go and be placed into solitary confinement. When we hear the vitrious (ph) language that he

displayed in court, it shows that he has a propensity against or for violence against law enforcement or other inmates, as well. But you`re

also going to have inmates that may want to make a statement in terms of assaulting him or vice versa. Therefore, he`s got to be placed in

isolation lockup.

BANFIELD: OK, real quickly, I got Ray Caputo back up. We lost your signal there for a minute, Ray, but you were about to tell me about Markeith`s

family showing up to support him in court today. What was going on in there?

CAPUTO: Yes, they were there, and it was relatively quiet, you know? The one person that I did hear from wasn`t a member of Markeith`s family, it

was actually Sade Dixon`s mother. And she had, you know, basically said she`s pleased and she wants justice served. But his family was there. And

it makes you wonder if any of his actions today were based on the fact he knew he had an audience.

[20:25:00]BANFIELD: Yes. Heather Hansen, real quickly on the forensics of this. You know, in this court appearance, there he was going on and on

about how -- oh, you know, there were other people shooting at the scene of my pregnant ex-girlfriend. What? There was another gun found there. You

can`t pin this on me.

yes, there were two guns found there. One was a nine-millimeter, OK. That was found there. And there were no shell casings from a nine-millimeter

found there, so that gun likely wasn`t fired at that location. This is not the two guns, so let`s pop those out of the way. This was at the arrest

scene. I`m talking about the murder scene of the pregnant ex-girlfriend.

But there was something very telling found at the murder scene of his pregnant ex-girlfriend, 11 40-caliber casings in a trail that went from the

front porch all the way to his car. So you know that stuff he was saying in court and F-ing off the judge and all of this, I guess he thinks he can

represent himself, but I don`t think he understands forensics.

HEATHER HANSEN, DEFENSE ATTORNEY: Well, to Jason`s point, that might work with the other prisoners, but when it comes to the court of law, he is in a

whole load of trouble. The forensics are against him. And we haven`t even talked about the charges that we`re going to hear tomorrow morning when

he`s going to be back in court to face the charges. And I do wonder whether he`s going think twice about representing himself when it comes to

the case against him for to killing that officer.

BANFIELD: Yes. I think it all comes down to three words, at this point. Bye-bye Markeith.

JACKSON: ... a broken jaw, but he sure does speak...

(CROSSTALK)

JACKSON: ... readily.

BANFIELD: Doesn`t seem to keep him quiet at all.

All right, guys, hang on for a second. This next story is about a divorce lawyer, one who uses his office to put female clients in a trance. That`s

weird. It`s also really disturbing. This man is also caught on camera, and the stuff he says to them and makes them do is worthy of some time

behind bars. You`re going to watch it happen in a moment.

[20:30:00] (COMMERCIAL BREAK)

ASHLEIGH BANFIELD, JOURNALIST, HOST OF CNN "PRIMETIME JUSTICE": Every night we pick the greatest lawyers to be on the panel. That`s why the three of

you are sitting here. And this next story is definitely not about a lawyer like you. Let`s just make that really clear. Because this lawyer, boy, oh,

boy. We go to lawyers. We need them. We need them because sometimes we`re in a vulnerable state. You know, like if you`re in a divorce case or

something.

In Ohio, seems like a lawyer named Michael Fine, who knew all about how vulnerable his clients were, and took full and criminal advantage of that.

His weapon, hypnosis. He put at least six of his female clients under a spell and under his control. And what he did during those trances is sick.

Thankfully, it was caught on hidden video. Take a look.

(START VIDEO CLIP)

MICHAEL KEITH, LAWYER SENTENCED TO JAIL FOR HYPNOSIS: Let`s take a deep breath. One more time. Okay. I gotta calm down, let`s do this together.

There`s two green dots in your fingers and watch how they draw together and focus. And as they draw together, at the count of one, you`re gonna feel a

wave of relaxation.

And two, you`re gonna feel really comfortable and really safe. And three, sleep. Deeper and deeper. One, two, three, sleep. Deeper and deeper. One,

two, three, sleep. Each time I say the word sleep, you`re gonna go deeper and deeper, ten times deeper. One, two, three, sleep.

(END VIDEO CLIP)

BANFIELD: The woman who was in that video, she had an inkling something was wrong, because she lost track of time while she was in his office. I think

she was there for about two and a half hours, couldn`t really remember much of it, and also her clothes were disheveled.

It`s a good clue. She said she didn`t go to the police sooner because she just thought they wouldn`t take her seriously. But then this surveillance

video by the police made the case as clear as day.

(START VIDEO CLIP)

FINE: You deserve intense pleasure. And every time I say the word pleasure, you cannot constrain or hold yourself back. Your entire body is a vessel of

pleasure. Arousal, excitement, and the better it feels the tight you grip my hand. You`re gonna feel such attraction and arousal and excitement. That

you`re gonna demand that I touch you and you touch me. Do you understand?

UNIDENTIFIED FEMALE: Yes.

FINE: Every time I touch you, it`s gonna be an incredible sensation. Incredible arousal. Excitement and intense pleasure. Because you are all

about pleasure. Do you understand?

UNIDENTIFIED FEMALE: Yes.

(END VIDEO CLIP)

BANFIELD: My God, that`s disgusting. But now you`re about to see the moment that Mr. Fine brings his victim out of her trance for someone else who

comes in the office. It`s the police. Because they know they have enough now to haul that guy off to jail.

(START VIDEO CLIP)

FINE: No stress. No tension. At the count of three. One, two, three. So how are you feeling? Are you okay? You said you were a little stressed this

week.

UNIDENTIFIED FEMALE: Yeah.

FINE: Okay. So we have some papers to go over and I have some questions that I have to ask of you.

UNIDENTIFIED MALE: Police officers! Step over here. Don`t touch anything. And don`t move. Just sit down. Sit down. You alright? Come with me. I`ll

take her. You have the search warrant?

(END VIDEO CLIP)

BANFIELD: He kind of looked like he knew exactly what was going on, didn`t he? Ricky Kalmon is a celebrity hypnotist and motivational speaker. He is

live with me now from Atlanta. First of all, Ricky, I cannot believe that it could be that easy to fall under someone`s spell, especially a divorce

lawyer.

Because you`re going there, you know, to talkabout marital assets and stuff. Not, you know, stop smoking where you expect to be hypnotized. But

it happened. I guess the question I have for you, did it happen because these people are already vulnerable if they`re in a divorce and it`s easier

to manipulate and to do this to someone if they are vulnerable?

RICKY KALMON, CELEBRITY HYPNOTIST AND MOTIVATIONAL SPEAKER: Hi, Ashleigh, and thanks for having me on. Very, very disturbing to watch that video. I

think it puts a scar

[20:35:00] on the lawyers and the hypnotists who do what they do so well. And it`s very disturbing that there is this cross-pollination of what this

guy is doing. I think the key, vulnerability.

I think that these women, unfortunately, trusted this person to help them. And instead of helping them in the legal aspect, he used it for something

else. It`s so disturbing. But I think it`s a matter of not really vulnerable to force somebody to go under vulnerability by intimidation to

do things in a very unfortunate situation.

BANFIELD: I do have one question for you because it`s been gnawing at me. The police were outside the door, right?

KALMON: Yeah.

BANFIELD: So it seems to me and I don`t know this for a fact. It seems to me she knew this was going to happen. She brought in that undercover video.

KALMON: Right.

BANFIELD: Could she have fought off this hypnotic episode and faked it just so that they could get enough and those cops could come in?

KALMON: Well, again, without actually being there and actually knowing everything going on because there`s so many probably moving parts to this

whole thing. My feeling about hypnosis is really simple. We all experience hypnosis. And even driving your car. Driving 20 or 30 miles and you can

only recall like 10 of them.

I`m sure you`ve had experience like that. You read something and not sure what`s going on, and then you realize you`re not even sure you know where

you are at that very brief moment. It`s kind of like a daydream. And yet at the same time, to answer your question, you know, I think that all hypnosis

is self hypnosis.

I think there`s a lot of intimidation factor here in a closed room. This woman was there. She`s relying on this person to help her and it`s just

really hard to watch and hear that there`s some trust issues there. And I hope that most people will watch it.

I thank you for having this on because most people should know that your lawyer is there to help you through a very traumatic, very hard time, and

you should trust your lawyer, not one like this. And the fact that he was using something just to help them relax is very disturbing.

BANFIELD: I think if your lawyer is holding himself out as a hypnotist and you can`t remember anything about a two and a half hour session, you got to

go to the police. By the way, I need to meet you at some point, because there are so many things that I need to be hypnotized for like I got to put

the spoon down and walk away.

(LAUGHTER)

KALMON: We can do that. We can do that.

BANFIELD: Oh, God, bless you. Ricky, thank you.

KALMON: There are some really positive things with hypnosis. This is not it. This is not it.

BANFIELD: That`s what I mean.

(LAUGHTER)

BANFIELD: That would be a great thing.

(LAUGHTER)

KALMON: Yeah. And, you know, to really answer your question about the vulnerability part and could she have resisted. She should probably, you

know, with such intimidation factor, how much was she really hypnotized? I don`t think we`re ever gonna know. But I think that we do that she was put

in a situation and felt as though she had to trust this person to help her and it really just went way too far.

BANFIELD: Guess what? He is now gone. Five counts of kidnapping. One count of attempted kidnapping. Twelve years, it was a plea bargain. Goodbye,

Michael Fine. Hey, Ricky, I hope to see you again soon. Thanks for being on tonight.

KALMON: Absolutely. I hope to see you as well.

BANFIELD: All right. Great. I`m going to turn your attention to this story that we saw come across our radar today. A mother`s sick and twisted idea

on how to keep your active toddler out of the way when you clean the house. She streamed the whole thing live on Facebook.

(START VIDEO CLIP)

UNIDENTIFIED FEMALE: They called children services on me. So (beep) now he ain`t in no corner. What are you going to do? (beep) call children services

now (beep). You can have his (beep) cause I don`t give a (beep) this time. You all can take him.

(END VIDEO CLIP)

[20:40:00] (COMMERCIAL BREAK)

BANFIELD: Any parent will attest to this. It is real tough to clean the house with a toddler running around. So a lot of us use a TV or maybe an

iPad as a babysitter. And even that has its critics. But there is one young mother in Reynoldsburg, Ohio who came up with a truly sick solution. She

taped her son to the wall. And then she broadcast it live on Facebook.

(START VIDEO CLIP)

UNIDENTIFIED FEMALE: You got the best mommy in the whole wide world. Don`t make me put more tape up there. Now, sit still. You can see the TV from

right there. You`ll be all right. You can`t clean without them running around tearing up? Tape them to the wall. You can`t cook or none of that

because they`re running around? Tape them to the wall.

(END VIDEO CLIP)

BANFIELD: Lieutenant Ron Wright is with the Reynoldsburg Police Department. He joins me live from Reynoldsburg, Ohio. Thank you, lieutenant. I am so

disturbed looking at that video. And I feel -- I mean, as a mother, your first inclination is throw the book at that young woman. Is that what

happened?

RON WRIGHT, LIEUTENANT, REYNOLDSBURG POLICE DEPARTMENT: Yes, ma`am. Thank you for having us on the show. Yeah, we did end up charging her with

abduction after observing the video, wanting exactly what you said to throw the book at her and make sure that she`s retrained of her liberties legally

by being locked up in the Franklin County Jail.

BANFIELD: So, question for you. Abduction, felony abduction. I know what she`s alleged to have done, certainly on video tape, falls within the

statute of description, but it seems weird to me to hear felony abduction instead of child abuse. Why not child abuse?

WRIGHT: Well, under the statute for abduction, it specifically spelled out restraining someone of their liberty by force under circumstances that

create a risk of physical harm to the victim or place the other person in fear. In this particular case, you have two incidents. One is physical harm

with the child`s mouth being covered with quite a large amount of tape as seen in the video, leaving only the nose for the child to breathe out of.

And also, obviously, the child is crying. As much as the child was crying, there`s fear that the child is experiencing. Two years old, probably does

not understand why

[20:45:00] they`re being restrained against the wall with large amounts of tape.

BANFIELD: Seems like she thinks this is almost funny as she is saying, this is what you, because they`re difficult. Just one clear, we are not able to

show the video in its perfect clarity. This is a two-year-old as you said, and two-year-old has privacy, so obviously we have a digitized image. It`s

hard to tell.

Is the child taped at the arms or the ankles and the wrists and then you mentioned across the mouth as well? I think that the tape across the mouth

must have loosened so you can hear the child crying. How was the child taped under that digitized video?

WRIGHT: Under the digitized video, the mouth is actually -- the child`s mouth is actually open and the tape is going across and wrapped around the

child`s head. And there`s multiple layers of the tape. It`s pretty thick.

And then there is tape across the forehead holding the child`s head to the wall, looking at a direction towards where she claimed the TV would be. So

when she did say he could see the TV from where he was at in the video, I`m assuming that`s why she taped his head in that direction so he could watch

TV.

BANFIELD: I want to play if I can. Lieutenant, I just to play one more moment from the Facebook that this woman did because she made another

video. Because other people saw this, and alerted the authorities, and CPS came, and had a conversation with her, and I don`t think she liked that, so

she made another video and here`s what she said.

BANFIELD: This time you all can take him. Lieutenant, is that child still in that home?

WRIGHT: No. Child Services did take the child and developed what`s called a safety plan. We worked with them today to make sure the child is put in a

safe environment. Part of the safety plan evaluates your family members in the local area or possible foster care to make sure that the toddler is

placed somewhere where they`re not going to put in a harm way.

BANFIELD: You know, one of the things that is not on the video, apparently she ripped that tape off that baby. It`s hard enough when we rip band aids

off ourselves, or if we ripped a band aid off our kids, but ripping that much tape off of a two-year-old and as the lieutenant just told us, all

across the forehead, across the mouth, through the hair. I mean, just the pain and suffering that little guy went through.

Thank you, Lieutenant Ron Wright, appreciate that. We`re going to watch to see what happens in that case. I want to take you to Chicago where the

police have released a crucial video of an officer shooting a person in the street because that person had been shooting into a crowd of people. You`re

going to see another angle that will will change everything.

And then break dance or break down when it comes to justice. A judge has let a rapper named Lil Cray with a really long rap sheet come to his

courtroom for a music video shoot. Yeah, wait until you hear what this young man is charged with. And that he was supposed to be home wearing an

ankle monitor. Uh-o.

[20:50:00] (COMMERCIAL BREAK)

BANFIELD: There are two really crappy robbers out there tonight. Because they went into the home of Jamie Smith. They went into her car. This is a

cautionary tale for all of us. And they got the garage door opener. Because the car wasn`t locked. And they opened the garage. And they went in and

they robbed her. Look at this. It`s all on video.

And why does this matter? Because this was the day of Jamie Smith`s husband`s funeral and they took all his stuff. They took his TV, they took

his tools. And police are trying to catch them. It`s Las Vegas, Nevada. If you know anything about this, please help Jamie. For God`s sake. She lost

her husband and these losers took his stuff.

I want to go to Chicago now where video has been released by police there. It is really intriguing. There`s been a lot of issues about shootings in

the street and police involved and this one you may feel differently when you see it. I want to start it from where some people come rushing out on

the bottom of your screen. They come rushing out of establishment and the guy on the far corner is shooting. You can see the smoke.

He is holding the gun out and shooting at these people. And the cops are right there. He has not dropped it. They shoot him in the street just like

that. And look at the girlfriend or friend. We`re not sure. No, no, no, don`t you come close. Don`t you come close. This is serious. This was

unbelievable how fast officers arrived. He died. That guy died.

At this point, it is an investigation, but they did release this video because they wanted you to see. Darius Jones was shooting into a crowd of

these people. Before they ultimately -- right in front of the cops too. They witnessed the whole thing.

Now I want to go to Ohio and Cleveland. In Cleveland, there`s this guy named Lil Cray. If you don`t know him, he`s known also as Crayshaun Bates.

He is 39 years old. He`s a rapper. Naturally as a rapper you want to film videos, and he asked if he could film his video in a courtroom. And a judge

said sure. The problem is Lil Cray is facing 19 charges including attempted murder and felonious assault. Oops. Joey J, how does this fly?

JOEY JACKSON, CRIMINAL DEFENSE ATTORNEY, CNN LEGAL ANALYST: When you got to rap, you got to rap. What can we say about it? That`s the reality. He`s

back in jail based on probation violation because he shouldn`t have been anywhere rapping. He shouldn`t been home. Didn`t get there in time.

BANFIELD: He`s an ankle monitor guy, right? You`re supposed to be waiting in your house.

JACKSON: They found him drunk in the basement.

UNIDENTIFIED MALE: He was out drinking first. That`s what he was doing.

UNIDENTIFIED FEMALE: He stopped at a liquor store on the way home. He`s getting good publicity.

[20:55:00] His song is indictment. He has got everything going for him.

BANFIELD: This is the video he wanted to shoot in court. By the way, the judge in this case said, I got a friend who is a music producer, I was

doing him a solid, but I don`t think he knew that the music video.

UNIDENTIFIED FEMALE: I mean, listen. Judges don`t always have good judgment. Just because they`re judges. We`ve seen this in trial many times.

JACKSON: When they talk to the judge, they`re like, he has constitutional rights. He`s innocent until proven guilty.

UNIDENTIFIED FEMALE: Right.

UNIDENTIFIED MALE: That wasn`t Lil Cray, that was Big Cray. Crazy.

BANFIELD: Maybe the judge was Lil Cray.

UNIDENTIFIED MALE: Big Cray.

BANFIELD: Big Cray, oh.

JACKSON: Title. Indictment.

BANFIELD: Indictment. Lil Cray knew what he was doing. He`s obviously creative. I just don`t know how creative he`s going to be when he`s

adjudicated for these charges. Thank you, everyone.

UNIDENTIFIED FEMALE: Thank you.

JACKSON: Thank you.

BANFIELD: (inaudible). Thanks, Joey, as always. And thank you, everyone, for watching. It`s been great to have you here. Hope you`ll join us again

on Monday night right here for "Primetime Justice." In the meantime, do not go anywhere. Because as you know, "Forensic Files" starts right after this

break.
