WASHINGTON (CNN) -- If and when the Florida Supreme Court rules on the deadline for Florida's vote certification, the matter could proceed to the U.S. Supreme Court.

It could come to the high court in two forms:

1) A petition to the full court -- as when the court is petitioned to hear an appeal in a case.

2) An emergency application for an injunction to lift the time limit in Florida. An emergency application would be directed to Justice Anthony Kennedy who is the justice with oversight of the 11th U.S. Circuit Court of Appeals which includes Florida. Justice Kennedy could act alone or in consultation with the other eight justices.

The court is currently in recess until November 27, but the justices -- or at least a majority -- are readily reachable for their vote on such a matter.

Appeals from state supreme courts move directly to the U.S. Supreme Court. And the federal court does rule on the constitutionality of state laws.
