OFFICIAL RULES AND REGULATIONS
1. NO PURCHASE NECESSARY: The Presidential Showdown Game: Pick the States ("Game") is open to all legal residents of the 50 United States, and the District of Columbia (excluding Puerto Rico), age 18 years or older at the time of entry, and Internet access as of October 5, 2004. Employees and their immediate families (spouses, siblings, children, household members and the spouses and children of the foregoing) of Cable News Network, LP, LLP ("CNN") (the "Sponsor"), Turner Broadcasting System, Inc., Time Warner, Inc. and their respective parents, subsidiaries and affiliated entities (collectively the "Game Entities") are not eligible to win the Game. By entering the Game, participants agree to abide by all terms of the Official Rules and Regulations applicable thereto. Subject to all local, state and federal laws and regulations. Some restrictions apply. Void wherever prohibited or restricted by law. 2. HOW TO ENTER: Sponsor is conducting a Game in connection with the 2004 U.S. presidential election (the "Election"). From October 5, 2004 - November 1, 2004 (the "Promotional Period"), entrants log onto the Game website, located at www.cnn.com. If entrant has not signed up for CNN.com Member Services, entrant can register for the Game by completing the CNN.com Member Services registration page. If entrant has previously signed up for CNN.com Member Services, entrant can simply enter his/her login and password and e-mail address to complete the registration. Each entrant will use an interactive feature that works as follows: There is a map displaying all fifty (50) states (each a "State"). Entrant will select the name of either George W. Bush or John Kerry in the candidate-selection box and click each State in which entrant believes that candidate will win the popular vote. Entrant will then select the other candidate and choose each State in which entrant believes that candidate will win the popular vote. Deadline to register is 11:59 PM ET, November 1, 2004. Limit one (1) entry per person. Following registration, each entrant can access the Game at any time during the Promotional Period by using a password assigned to him/her, to change or add to his/her selections. Deadline to make changes is November 1, 2004, 11:59 PM ET. There is one (1) tie-breaker question for each entrant to answer. Use of any automated entry software is prohibited. No mechanical reproductions or facsimiles accepted. Sponsor is not responsible for incomplete, misdirected, lost, late or illegible entries. Sponsor is also not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed software transmissions which may limit an entrants ability to participate in the Game or damage to user's system as a result of participation in the Game or downloading any information necessary to participate in the Game. Sponsor reserves the right in its sole discretion, to cancel or modify the Game should any computer virus, malfunction or other cause beyond their control corrupt the administration, security or proper operation of the Game. All entries become the property of the Sponsor and will not be acknowledged or returned. False or deceptive entries or acts, as determined by sponsors, will render the entrant ineligible. 3. HOW TO WIN: One (1) Grand Prize winner (the "Winner") will be determined by the Sponsor following the final official results of the Election, on or about November 3, 2004, or such later date when the final official results of the Election are determined. The decisions of the Sponsor will be final and binding. Winner will be entrant who makes the greatest number of correct matches of candidates and States. In the event of a tie, the entrant who is closest to correctly answering the tiebreaker question (the "Tiebreaker"), will be the Grand Prize Winner. In the event a tie still exists, the Grand Prize Winner will be determined by random selection. The odds of winning will be determined by the total number of eligible entries received. The Grand Prize Winner will be notified by telephone, regular mail or e-mail and must meet all eligibility requirements including the execution and delivery of all necessary releases. If the Election is delayed, extended, interrupted, cancelled or shortened for any reason, the Game may be postponed, extended, shortened or terminated at the sole discretion of Sponsor. If a dispute arises regarding who submitted an entry, the entry will be deemed submitted by the holder of the e-mail account as determined by Sponsor. 4. PRIZES: One (1) Grand Prize Winner will receive a 30 inch LCD Flat TV HDTV and One Thousand Dollars ($1,000) in cash, at a total approximate market value ("AMV") of Four Thousand One Hundred and Fifty Dollars ($4,150). The reporting and payment of any tax liabilities incurred by the entrant as a result of this Game and any prize won are the sole responsibility of the entrant. No substitution or transfer of prize or cash redemptions permitted by winner. The Sponsor reserves the right to substitute a prize of like value in the event the described prizes, or any portion thereof, is unavailable for any reason whatsoever. All prizes will be awarded. 5. GENERAL RULES AND REGULATIONS: By entering the Game, entrants grant Sponsor the right, unless prohibited by law, to use their names, voices, pictures and likenesses, without compensation, for the purpose of advertising and publicizing the goods and services of the Sponsors and all matters related to the Game in any manner or medium, throughout the world in perpetuity. Winner may be required to sign affidavits of eligibility, tax acknowledgement forms, liability releases and, except where prohibited by law, use of name and likeness releases ("Winner Documents") and return within seven (7) days of issuance. Noncompliance within this time period may result in disqualification. Return of the prize or prize notification as undeliverable, failure of Sponsor to contact winner based on contact information provided at registration, or failure of potential winner to respond to notification attempts will result in disqualification and an alternate may be selected at the Sponsor's discretion. In the event the winner declines the prize or fails to return completed releases, Sponsor may elect, at its own discretion, to select an alternate winner. By entering, entrants agree to release the Sweepstakes Entities from any and all liability claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize, or while preparing for, participating in, and/or traveling to any prize-related activity. The Sweepstakes Entities expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prize awarded. In the event more winner notifications are issued, or more winning prize claims are received, than the number of prizes set forth in these Official Rules due to computer, printing, seeding, human, or other error or problem, a random drawing will take place from all eligible prize claims for the prize at issue to award the proper number of prizes as set forth in these Official Rules. In the event of sabotage, acts of God, computer virus or other events or causes beyond the Sponsor's reasonable control which corrupt the integrity, administration, security or proper operation of the Game, Sponsor reserves the right to cancel or suspend the Game. In the event of cancellation, prizes will be awarded from among all eligible, non-suspect entries received prior to the event requiring such cancellation. Notice of cancellation will be posted at www.cnn.com/presidentialshowdown. 6. CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sponsor, shall be governed by, and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules or provisions (whether of Georgia, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Georgia. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. 7. OFFICIAL RULES OR WINNER'S LIST: For a copy of the rules or the winner's list (winner's list available after November 2, 2004 or date final results of Election are determined), send a request and a self-addressed, stamped envelope (residents of VT may omit return postage) to the following address by November 2, 2004 for "Rules", and by December 2, 2004 (or later date if Election results are postponed), for "Winners" (please specify The Presidential Showdown Game: Pick the States Rules" or "The Presidential Showdown Game: Pick the States Winners."
