Man suing wife for smoking drops lawsuit

CHICAGO (CNN) -- A man who sued his wife of 43 years for smoking in the house has dropped the lawsuit because she has given up cigarettes.

"Victory is mine. Victory is mine," Col. Richard Thomas said after dropping the lawsuit Thursday. "Her hair smells sweeter, her kisses are sweeter, and most important of all, she has stopped the constant coughing at night, which terrified me."

Thomas filed the lawsuit under the federal Clean Air Act, asking a court to bar his wife, Sally, from smoking in the house. Thomas said the lawsuit pressured his wife, who he said has not smoked for a month.
