Davis to Continue Campaign

KYRA PHILLIPS, CNN ANCHOR: Our Candy Crowley now joining us in the Los Angeles bureau. She's going to add her little insight, 2 cents into all of this. I guess, where does it go from here? What do you think, Candy? Does the campaign -- will it go on? Will these interviews continue? Will all the...
CANDY CROWLEY, CNN SENIOR POLITICAL CORRESPONDENT: Sure. I mean the campaign always goes on. And it will go on in this case because, first of all, right now it's unsettled. But second of all there's going to be a recall because they've met the criteria for having a recall. The question now is just a matter of when.

This has got to be great news for Gray Davis. From the very, very beginning, the Davis people had wanted this not to be in October, but maybe to be in March when the primaries are. They wanted it moved forward because time as proven, over the past month or so, seems to be on Gray Davis' side.

So this is pretty good news for him, not only because some of the people affected by these punch card ballots are minorities and therefore more likely to be Democrat. But because over time, perhaps the economy gets better.

We saw in the last month or so that Gray Davis' is unfavorable while still astronomical are not as bad as they used to be. So his trajectory was in the right direction. California was split on whether or not he should be recalled.

So time is a friend of Gray Davis on this and he must be liking this decision.

PHILLIPS: I was going through the wires and trying to find that last date when this issue sort of came up and talking about delaying the election. I found it. The San Francisco-based appeals panel that overturned an August 20 ruling by U.S. district judge of Los Angeles who said he would not delay the recall election. Wilson (ph), the judge said in doing so that would be acting against the will of the California voters.

What's the difference between that and this? I'm a little confused.

CROWLEY: Different courts. You know, I mean if there's one thing we've learned, we don't know how any particular court or three- judge panel appellate court is going to act. I mean this goes to the next step. It could be that the next step is, OK, keep going with the election which is another reason why this campaigning is going to go on because you just can't tell.

The legal arguments tend to get down to state voting records and state voting laws versus now what's the Supreme Court law is set out in Florida. So this is going too take just a little while to sort out.
