Subject: New York City To Challenge Line-Item Veto

The city of New York will file suit against the White House over the constitutionality of President Clinton's use of the line-item veto on August 11th, CNN has learned.

This is the first lawsuit filed since Clinton used his new power.

Sources say the issue they are suing over is Clinton's veto of a Medicaid provision in the balanced budget that would have allowed the state of New York to resolve its dispute with the federal government concerning Medicaid matching funds.

The Supreme Court ruled on June 26th by a vote of 7 to 2 that there was no standing for the charge because at the time Clinton had not yet used the new veto power.

New York Mayor Rudy Guiliani and Senator Daniel P. Moynihan (D-N.Y.) will hold a briefing at 10:30 a.m. EDT Thursday in New York City to announce the suit.
