Marriage annulled after wife thinks about affair

Rome, Italy (CNN) -- Italy's highest court ruled that a couple's marriage could be annulled because the wife contemplated having an affair, even though she did not actually commit the affair.

The decision handed down recently by Italy's Court of Cassation upheld a lower court's decision and also a decision made at the Catholic Church Ecclesiastical Court.

The court's ruling said that the wife failed to comply with one of the principles of marriage and the court considered her spoken desires for an open marriage as good as committing adultery, a court official said.

The court's decision also took away the wife's right to have alimony, the court official said.
